Ako dati ang ikinakatakot ko is kapag hindi ko nabayaran ang utang san ako pupulutin?
But sobrang desperado ko na noon that's why isa sa option ko is magpakulong or "upuan" ang utang. Yan ang uso sa UAE. Contrary sa common belief na once inupuan (Jail Serve) mo yun case ay abswelto ka na, hindi po. Still need mo pa rin magbayad. Pero kanya kanyang DISKARTE lang talaga.. Yun ang Ticket mo, Yun ang Salvation mo lakipan pa ng sangkaterbang dasal.
I have pending CC's and Personal Loan and just transfered to new Job back then, hindi ko alam na dahil sa notice na binigay ng old company ko ito MASHREQ ay nilagyan ako ng kaso. So by 2010 October ng plan ako to have vacation, since lahat ng gratuity payment ko ay kimakam n ng mashreq at patuloy pa rin naman ako sa pagbabayad sa kanila i was thinking na MALINIS ako..
ALAS!! ayun naharang ako sa airport.. masakit sa loob iyung mapapaligiran ka ng mga Pulis etc.. super stressful you could never imagine yung hiya, sakit ng loob etc.. akala ko noon mamamatay na ako.. Dahil din sa scenario na yun ay ngsulputan ang iba pang CC's at ngsampa ng kaso.. total kaso ko is 3.. Ayun.. Suma tutal ako ay ipiniit sa Emirata ng mga Arabo.
Sa utang kong lampas isang milyong piso, nanatili ako doon sa loob ng 41 araw.. pagkalabas na pagkalabas ko hingi agad ako ng clearance, pede mo ipagawa yun sa kapulisan nila buburahin lahat ng rekord mo.... pagkakuha ko non buy na agad tiket at umalis na ako doon.
Ngaun ay nagsisimula na ako ng bagong buhay. OO naghahabol pa rin sila sa pamamagitan ng Bilkish pero wala akong pakielam.. ang panakot nila ay makukulong ako sa UAE, been there done that.. pinagtawanan ko lang sila... BTW, ayus pala sa loob ng piitin nila doon stress free hehehe..pero Salamat sa Panginoon dahil pinalaya nya ako agad..

1. Kahit mamatay na ako hindi ko na mababayaran ang amount na yan
2. Basta hingi ko lang sa inyo wag nyo akong i-harass dahil alam ko ang karapatan ko.
3. Pinag handaan ko na ang pagkakataon na ito kaya kumuha na ako ng abogado (kahit wala).
4. Sabi ng abogado ko ibigay nyo sa akin ang.....(makikita mo yan sa mga advice ni banker, like, SOA, etc)
5. Mas gusto ko sa korte na tayo mag harap at wag nyo idaan sa dahas at takotan
dahil hindi ako natatakot sa inyo.

Dept. of Foreign Affairs
MANILA, Philippines—The Department of Foreign Affairs (DFA) warned the public on Friday about fake e-mails supposedly coming from the government agency.
The warning came after the Philippine Embassy in Singapore reported that a Filipino there received an e-mail from “consulate@dfa.gov.ph.”
The e-mail said the Filipino was the subject of a request for a warrant of arrest “for his alleged involvement in some criminal activity.”
“The DFA wishes to inform the public that the above-mentioned e-mail account is not an official DFA account,” the foreign office said.
Notices of legal proceedings are never sent through e-mail and applications for the issuance of warrants of arrest are filed before the courts and not the Department of Justice, it said.
“The public is advised not to fall victim to this modus operandi and to report any such e-mails to the DFA, the nearest Philippine embassy or consulate or the National Bureau of Investigation’s Technical Intelligence Division (raid@nbi.gov.ph),” the DFA said.

- Authority To Perform Specific Acts as Collectors
- Approved Assignment of Accounts of the Collection Agency
II. Collection Agency
- Collection Arrangement between bank and Collection Agency.
- Notarized Secretary's Certificate or Board Resolution of the bank :
a. authorizing appointment of specific Collection Agency
b. authorized signatory for the bank
- Copy of Bank Endorsement as required by BSP Cir. 702
- Collection Agency's Authorized Delegated Compromise Terms,Conditions and Limitations
- Collection Agency's authorized signatory and specimen signatures
III. Statement of Account
- Latest and dated Statement of Account
- how much is owed ( principal, interest, other charges, expenses etc.)
- Indicated applicable rates
- Indicated covering periods
- signed by authorized signatory of the bank
IV. FORMAL OFFER
- in writing
- duly signed by Collector

Control The Conversion
This is a basic for collector harassment calls.
Let's try it as a diskarte:
CA : Hello, puede kay Ms. Dina M. Akabayad? ( pag full name, collector ito!)
DM : Yes, this is Ms. Dina ( Mag-ingles ka ; CA can't)
CA : Ano ba plano mo sa utang mo ( starting to control the conversation)
DM : Isa lang. I'll be paying it in full IF you can provide me with an SOA
CA : naku, delaying tactic yan! (usual CA spiel on SOA requests)
DM : If you can't provide it immediately, who's delaying it?
CA : kung bigyan kita, mag-bayad ka kaagad?
DM : Of course! have it "certified correct" by the bank.
Saan mo gusto mag-bayaran tayo, sa court, police precinct or NBI?
( now you are controlling the conversation)
CA : M'am, bawal po mag-tangap kami ng bayad. deposit mo na lang sa banko.
DM: Let's do it in front of a witness. you are authorized to collect, di ba? so, Ikaw na mag-deposit.
Anybody can deposit my payment anyway, right?
CA : M'am bawal po talaga. ( now, he is on the defensive)
DM : Oh, sige, you ask your boss about it. Payment is not a problem.
It's you who has a problem. call me again!

Basic Collection Techniques
1. Get in touch with defaulters and use falsities like:
- This is fiscal/police/judge Ek-ek from legal/bank/Interpol/DFA/CIDG/Air Force
- a case has been filed against you
- You have a pending warrant of arrest to be served today
- We will visit your home/office
- We will publish your face in the newspaper
- Pending criminal case for RA 8484
- a package is pending for you
2. Tell them to call a number (YOUR NUMBER!).
3. Threaten them that if they don't, you will proceed with filing of the case or get their things, travel ban or
any other consequences(kahit hinde totool)
4. Once they call,increase the threat!
e.g.
-give them one day to pay their one million debt!
-simply pay P1,000.00 to "hold" everything.
- you will call their HR/Boss/Chairman/Janitor/Priest/Barangay
(defaulters will not question these things anymore. they lost their common sense)

properties unless you pay or call "atty. ek-ek".

THE 1987 CONSTITUTION
OF THE
REPUBLIC OF THE PHILIPPINES
ARTICLE III
Section 1—NO PERSON SHALL BE DEPRIVED OF LIFE, LIBERTY OR PROPERTY WITHOUT DUE PROCESS OF LAW, NOR SHALL ANY PERSON BE DENIED EQUAL PROTECTION OF THE LAWS.
I will not delve on the legal aspects and requisites.
It's enough that you know :
Nobody can enter your house without permission:
(1) the offender is a private person
otherwise, it is Violation of Domicile:
- the act of any public officer or employee who, not being authorized by judicial order, shall enter any dwelling against the will of the owner thereof, search papers or other effects," and refuse to leave if asked.
(2) that he enters your dwelling ; and
(3) such entrance is against your will.
What if he gets my property/ies?
then, the entry maybe absorbed as an element of the crime, such as in robbery!

Low Office
A collection agency is a business that pursues payments of debts . Most collection agencies operate as agents of banks and collect debts for a fee or percentage of the total amount owed.
A law firm is a business entity engage in the practice of law. Functions are to advise clients and to represent them in civil or criminal cases.
- A Low Office is actually an agency that thinks it is a law firm but actually is merely a collector!
