Threats to publish your name, picture and your face in the newspaper
is silly.

If they do that, WALA ka ng mabasa sa newspaper kundi pur0
pangalan ng 500,000 CC defaulters! Incredible? its like
reading who passed the board exam, complete with your face
and picture.

BTW,ang ba ang pagka-iba ng face and picture?
(It's also libel - a criminal case - no matter the reason)

Usual  opening line of collector : " ano plano mo sa utang mo"?
Reply : "Siempre, babayaran natin. Pero ang sabi ng abogado ko,
             antayin daw muna namin yung Summons tapos doon sa
             korte magbayad"


Rules When Taking Collectors' Calls

1.Take the call. It can't kill you anyway - to put a stop on follow-ups.

2.Make your reply simple - answer with a "yes" or "no"
   No need to explain, plead, argue. useless.
   walang nanalo dyan.

3.Standard Reply ( or a variation of it)
    "according to my lawyer, sa court na lang daw natin
     pag-usapan ito. Formal at legal. Ayaw mo na nyan?"
     you will wonder why they will discourage you from doing that.

4. After which, DON'T LISTEN anymore kahit ano pa sabihin niya.
    simply stick to that line above.

5. If the caller starts berating you, what is there to listen
    for? kaya, hang-up or let the table, which has no brain too,
    to listen to him instead.

These suggestions are practical and common sense approaches.
why listen to a @#$%^ caller?

Hi banker... I was so thankful that i found this blog... Regarding my HSBC card, last year an agent called and told me to pay my outstanding balance amounting to 24k, but he said to me that there is a discounted amount that could be offered to me, amounting to 10k. I made a loan to our company just to pay that amount, but I made it in 2 payments, 5k and another 5k. He promised me to give a certificate of full payment on that. But time passed by, i have not receive any confirmation from that agent. After 5 months they called me up with another agent, asking for my payment. I told him that I made a payment last year, but I never recieve any certificates. I forgot to get his name, and told me that "naloko daw ako ng agent na yun, marami na raw complaints na ganun". Afetr that call, i recieved a txt msg, that I have to pay my account or if not they will go to our barangay with the attorney. Please help me with this, advise me what will i have to do. Thank you very much...

I havent paid my chinatrust loan mag 2 months na po.sayang kasi june 2010 na kasi ako matatapos pero di na tlaga kasi kaya cause na lay off po ako last nov. sir, paano po yung check na i have signed before? baka ma estafa po ako eh..pero wla naman akong cheking account eh...i dont understand kung for wat yung checks na pina sign nila sa akin before pagka kuha ng loan ko.. please advice po. thanks!


Please call them up and inquire kaninong account name yung checks
which you signed and you will be in for a surprise!

Hi sis, ask ko lng if you were able to received your cert after settling your card, kse I had settled my balance worth P87K for HSBC, but it's been 5 yrs i have not rceived my cert. as what Molaer and law office promised to me. I tried doing ff up viA hsbc online but sadly I'm only getting electronic response

Often times, we allowed ourselves to be shouted upon, pagagalitan,threatened,pinapahiya,trampled upon, and
eventually lose our self-respect and dignity, not for us
alone, but also our parents,wife,husband,officemates
and even our innocent children.
We plead,we argue,explain,even paying our last peso
- all because we are afraid that they will sue us.

Maling akala pala!

Dare the bluff.Let us meet them in court instead.
It's actually the best option we can have.
Why?

1. To finally put a stop to these humiliations and harassments
by these abusive collectors who act as if they own us.
Ano pang legal ek-ek ang masasabi nila after the dare?

2. It means any negotiation is formal,legal and appropriate.
Remember the last time we paid, out of fear, then learn later
on that our utang pala simply did not move at all?

3. Our debt will be rationalized - The court,for several times,has
ruled against those "excessive,unconscionable and exorbitant,
hence,contrary to public morals" charges including 25% attorney's
fees,42%p.a. interest, 60%p.a. penalty, absurd over-the-limit fees, etc...

4. Repayment would be more practical - pay what we can afford, not
what is forced upon us.

5. Less expensive,as most cases would fall under Small Claims Courts

6. Lastly, lawyers are not allowed!

The following issues hopefully will be resolved:
1. Is it true that you have an utang? Yes
2. Is it fair? No
3. Do you have money/properties to pay? No

* investigate crimes and other offenses against the laws of the Philippines, both on its own initiative and as public interest may require;
*assist, when officially requested in the investigation or detection of crimes and other offenses;
*act as national clearing house of criminal records and other information for use of all prosecuting and law enforcement entities.

Utang is not a crime. If unpaid, its a violation of certain conditions of a Contract or Kasunduan.( Just like your marriage contract. lol!)

1. Go to the bank PERSONALLY and talk to an account officer.
    But be ready to get frustrated if they won't accommodate you.




2. Submit a formal letter requesting for an updated Statement of Account with the following details:
    a. Principal
    b. Interest/fees
    c. rates
    d. covering period


3. Once received, review for accuracy.( attorney's fee @ 53%! ; see below)





4. Request for re-computation/waiver/reduction.


5. Once total amount  due is ascertained, offer ONLY what you can afford to pay regularly.



6. Once approved, DOCUMENT everything.




7. Start paying.

Gud Day, Sir Rene/Banker...Hope you still remember me. This is Six Cards. I've been so far living in some peace now. I think it's been 6 months since I last consulted you in this blog regarding my KAUTANGANZ.

At any rate, I just would like to share with our readers that I just came home from a 1-month vacation from the USA. Sobrang kinabahan ako, although I've been guided by my lawyer and by what Sir Rene has been posting here regarding hold-departure orders, kinabahan pa rin talaga ako na baka may sabit ang passport at US visa ko.

Awa ng Dyos, lusot sa immigration, at PARANG WALA AKONG UTANG.


Hope this enlightens everybody who have fears of traveling.

I've been receiving concerns about  fears and threats from collectors if you don't pay,  like  :

- filing a case
- visits
- warrants
- amnesty with deadlines
- all sorts of LIES

Please dare their bluff.

di ba mas ok pa ito?
stop arguing with them.
useless.
stick to this line.
and you will be amazed why ayaw nila.

What's the Bible's opinion of Debt Collectors?

I've been a Christian for about 3 years now, and I started a job as a debt collector about 1.5 years ago. Though I'm sure God found this job for me, I cant shake the feeling that it's... just not a good job. The bible says a lot of bad things about tax collectors, can these be extended to debt collectors in general?

Treat people with respect, show sympathy, act honestly. 
Nothing wrong with being a debt collector if you do those things.
Perhaps God will lead you to something else later on, but do your best at the job you are in now.

simple.
why, they won't even give you their real names!
why then would you believe anything they say?

Simply tell them that you talk about this issue in court
- formal, legal and fair.

hi banker,planter and bloggers

...as promised here's what happened when i attended the hearing for civil case at makati trial court..scheduled at 8:30 am pero i arrived around 9:15
as i entered the court room on going na yung hearing daming tao so as a 1st timer ,
lumabas muna ako at nagmasid masid almost 30 cases pala ang dininig for 8:30am sched at
may sequence pala pang no. 12 ang case ko

bumalik ako sa loob at naginquire sa katabi ko no.20 na pala ang dinidinig ng hay nalagpasan
na pala yung case ko...lakas loob ako lumapit sa clerk of court na nasa tabi ng judge at
naginquire kasi late ako dumating at nadidinig na pala yung case ko at nagrender na ng
recommendation ang judge , mabuti mabait yung clerk pinagsign ako sa minutes ng
hearing at diniscuss sa akin na thejudge requested the citibank to submit original
signed application form ,charge slip and otherdocumentary evidence within 15
days before she render a decision.

dumating akong walang lawyer with me , tinuruan ako ng clerk tinuro sa akin yung
 mga abogado ngcitibank tabihan ko daw at kausapin kung interested daw akong
 magbayad ,but if not wag ko nalang daw lapitan at umuwi na lang daw ako hehe turo
 sa akin ng clerk...

out of curiosity , kinausap ko pa rin 3 lawyer ng citibank tapang ko hehe, di pa rin daw
ubra yung 500.00/mo. at kumuha na lang daw ako ng lawyer para in case may decide
yung judge ipare-open ko daw yung case kasi nasa 166k yung sinisingil nila sa akin..
sabi ko i do not acknowledge the 166k , i wanted to see first the original signed charge
slip so i can check if authentic signature ko yun talaga..nakakatawa lang sabi nya
sa akin ako daw ang magpresent ng original charge slip kasi may copy rin naman
daw ako non...sabi ko naman kayo po ang nagrereklamo so nasa inyo po yung
burden in presenting the evidence...

then after the session ends tinanong ako ng clerk kung anong nangyari sa usapan
namin ng citibank, nakakatuwa lang sabi ng clerk sa akin nasa sa akin daw kung kung
gusto ko magbayad or hindi ..once the judge decides in favor of the bank for
garnishment daw po lahat ng properties ko, bank deposit sabi ko hehe wala po ako
kahit isa sa nabanggit nyo ang meron lang ako is payroll account..sabi ni clerk eh di
hayaan mo na lang yung judge decision kung wala ka talagang ibabayad...
