The Court Decision ( Writ Of Execution )
This is a portion of the court decision commanding the sheriff to:
1. demand from defendant the immediate payment of the obligation,
plus interest UNTIL FULLY PAID ( even up to 100 years?)
2. plus expenses (sheriff's fee advanced by the bank for him)
3. that he can recover ( especially garnishment of deposit/s)
4. within 30 days including a report ( no assets can be found?)
what's so scary about that?

The court is your friend. Don't be afraid. It is just especially for
"Sum of Money" cases. Win-win po yan. consider the usual decision:
"Pay ( your utang) plus 6% interest p.a. UNTIL FULLY PAID"
If it takes 100 years, so be it!
What if you have no money to pay? di wala. hinde ka naman puede

QUESTIONS
Dealing With Collectors
So, you want to deal with a collector but just want to be sure?
1. Is he authorized ( check BSP Cir. 702)
2. What is his Referral Code ( he should know!)
3. He is authorized? what are the limits of his "authority"? - amount/conditions
4. Covered by yan ng Corporate Board Resolution ng bank?
5. Statement of Account - is there a breakdown of your debt, duly certified by a bank officer? legit?
If he pass these tests, there are MORE!
is he authorized by the Collection Agency? by authorized signatories? valid ID and your meet him personally and not just another "anonymous"?
you see, what is better that seeing him in Court - formal, legal and fair?

GARNISHMENT OF DEPOSITS ESPECIALLY PAYROLL
The Notice of Garnishment to Land Bank states:
"money... which you may have in your possession/control".....and
"report it within 5 days"
It does not say ALL the money you have now and forever!
but wait:
Rule 39 of the Rules of Court:
Section 13.Property exempt from execution.
(f) Provisions for individual or family use sufficient for four months;
Is the Land Bank Manager working for the collection of other bank's debts?
it is illegal and immoral.

Lessons For Today
1.
T 1. Credit Card problems are always the same. Make it a habit to BACK READ.
2. 2. It is always better to deal with the court – formal ( you know who you are talking to ) ; legal
( everything is documented); fair ( payable when able pa!)
3. 3. You are not obliged to reply to queries/demand of CAs ( see no. 2)
4. NEVER trust/fear CAs– you don’t even know who you are talking to. Even their names are often not true.( see no. 2 again!)
Lessons For Today

3. You are never obliged to answer anything from the CAs ( see no. 2 above instead)
4. NEVER TRUST CAs - hinde mo nga sila nakikita. even their names are only aliases.
PLEASE EXPLAIN!
Make your life simple - don't explain nor tell your life story why you cannot pay. useless. it won't erase the fact that may utang ka pa rin. and they are not interested anyway.
You are not in any manner required to explain especially to collectors!

I will limit my posts to three to four since most people don't back-read anyway.
