  1. Abroad Working – you cannot be sued since Phil. Laws are only applicable here.
  2. Barangay – walang paki. see RA 7160 Section 408 ( no corporation) ;  as clarified by    Supreme Court Circular 14-93 
  3. Bouncing Checks – bank does not file BP 22 ; checks as loan repayments are not covered.
  4. Contacting thru Calls – tell the caller “pag-usapan na lang natin ito sa korte para legal lahat. Masama ba un?” then don’t argue anymore.
  5. Contacting thru Letters – sign ANYWHERE, don’t open, look for nearest trash can.
  6. Contacting thru Text - press 'delete'
  7. Contacting thru Visits – see no. 3 above.BTW, walang puede maka-pasok without your permission. That is robbery. lol!
  8. Court Case – Not all banks file collection cases because it's useless. You don't even need to attend. Decision is always “ You pay!” eh, walang pera. That’s the end kasi walang firing squad pa sa Pinas no? 
  9. Fraud - Ang hinde pag-bayad ng utang is a violation of your CONTRACTS & OBLIGATIONS.  hinde po ito criminal case.
  10. Garnishments & Attachments – If you have deposit with the same bank as your card issuer, it can go after your money, AT THEIR OPTIONS. otherwise, banks only go for deposits, only ONCE against your own account AFTER court decision, except payroll and foreign currency deposits dahil bawal.  You can withdraw naman prior to decision. Why wait?  Properties? No attachments. for practical reasons.
  11. NBI – handles criminal cases only. Utang is under Civil Case. ( read no. 9 above)
  12. Negotiation of Debts – see No.4 since “payable when able" doon kung sa court ka.
  13. Newspaper – have you read a defaulter na na-published na? scam ni kolektor.
  14. RA 8484 – applicable ONLY if you used a fake card.
  15. Scandal – Sino ba ang pina-pakulong sakaling nag-eskandalo? (libel/defamation/threats are CRIMES!)

  10. Garnishments & Attachments – a) deposits - If you have deposits with the same bank as your card issuer, it can go after your money, anytime, even without a case, AT THEIR OPTIONS.      
  11. Garnishment Order  - comes only AFTER a court decision and only ONCE agaisnt your own account except for payroll, pensions and foreign currency deposits dahil bawal.  Attachment of Properties? None  p.s. Hinde din puede kunin  ang deposit ni Juan kung si Pedro ang may utang. common sense.
  12. Hold Departure Order - non-payment of utang is a civil case. Only criminal cases have HDOs
  13. Housing loans - you can avail Pag-ibig loans because it’s against your house and lot plus savings with them
  14. NBI/PNP – handles criminal cases only. Utang is under Civil Case. ( read no. 9 above)
  15. Negotiation of Debts – see No.4 since “payable when able" doon kung sa court ka.
  16. Newspaper – have you read a defaulter na na-published na? scam ni kolektor.
  17. RA 8484 – applicable ONLY if you used a fake card. You are not OBLIGATED to inform them saan ka lumipat or if you want tochange your number. gusto ka lang nila lokohin para ma-contact ka.
  18. Scandal – Sino ba ang pina-pakulong sakaling nag-eskandalo? (libel/defamation/threats are CRIMES!)
  19. Spouse Liability - None. Because walang conformity ng spouse sa debt instrument. court ruling yan.
  20. Subpoena( criminal) and Summons( civil)  - an invitation to hear your side on a complaint .
  21. Warrant of arrest-  issued by the court for criminal cases only

Salary Garnishment

Garnishment of deposits comes AFTER a writ of execution, which comes AFTER a court decision.
the notice of garnishment simply states:
" kung may deposit sa inyo sa Juan, paki-hold, then forward it to the sheriff"
the sheriff then submits a report within 30 days.

Although sometimes it is hard to distinguish which is salary on deposit and what is savings but this is being only once. ( common sense?)




"It stands to reason that only natural persons whose salaries, wages and earnings are indispensable for his own and that of his family’s support are exempted under Section 13 (i) of Rule 39 of the Rules of Court."

Rules of Court
exemption:
(1) So much of the earnings of the debtor for his personal services within the month preceding the levy as are necessary for the support of his family (Sec. 12, Rule 39).


 Only salary "due" the judgment debtor is subject to attachment and execution, and then ONLY IF  it is not made to appear by the affidavit of the debtor or otherwise that such earnings are necessary for the support of his family. ... .

Regular creditors cannot garnish your wages without first suing you in court and obtaining a money judgment.You can challenge it court or apply other diskartes.

A Defaulter Wanting New Credit Card

Who said you cannot get a credit card because you are a defaulter?
1. Get a secured card - against your deposits ( 1:1), or
2. If you have a sizeable deposit, the manager will simply give you one, or
3. Let the commissioners worry about how you get to approve one! or
4. Combination - transfer your deposits to your love ones ( to increase maintaining balance)
    then apply as Supplementary CH!

you see, there are many diskartes.
just be creative.
